TERMS AND CONDITIONS OF BOOKING
1. Scope of Service & Tour Operator Exclusion — Guided walking tours are conducted exclusively by a Licensed Tour Guide. Services are strictly limited to cultural guiding. The guide does not operate as a travel agency or tour operator; any additional services (transportation, meals, entry fees) are arranged and paid directly by the client to the respective providers.
2. Entrance Tickets — Entry fees for monuments and archaeological sites (e.g., Ancient Theatre of Taormina, starting from € 14) are not included in the tour rate and are to be purchased separately by guests. Ticket prices are set by the managing authority (Aditus Culture) and may vary independently of the guide. Updated rates and reductions can be verified on aditusculture.com.
3. Weather Conditions — Tours take place as scheduled in all weather conditions, except in the event of official severe weather warnings issued by the Protezione Civile.
4. Booking Deposit — A booking is officially confirmed upon receipt of a deposit via bank transfer (IBAN) or PayPal. Payment of the deposit constitutes full acceptance of these terms.
5. Public Holidays & Night Service — In accordance with the official Taormina Tourist Guides Association regulations:
Services provided on official public holidays are subject to a 30% surcharge on the basic rate;
Evening and night services (between 8:00 PM and 7:00 AM) incur a fixed supplement of € 50.00.
6. Overtime — Any extension of the tour duration beyond the agreed schedule upon request by the client is billed as overtime (€ 40.00 / hour).
7. Cancellation Fees & Exclusion of Right of Withdrawal — Pursuant to Art. 59, paragraph 1, letter n) of Italian Legislative Decree 206/2005 (Consumer Code), the 14-day statutory right of withdrawal does not apply to leisure activity contracts with a specific date or performance period. In accordance with the regulations of the Taormina Tourist Guides Association, late cancellations by the client are subject to the following charges:
30% of the total fee for cancellations made 8 days prior to the service;
50% of the total fee for cancellations made 5 days prior to the service;
100% of the total fee for cancellations made 3 days or fewer prior to the service.
8. Delays, Waiting Time & No-Show — The service duration is calculated strictly from the agreed booking start time. The guide's waiting time at the meeting point is up to a maximum of 30 minutes and is included in the total tour duration. In the event of a client delay, the tour time will be reduced by the duration of the delay. If guests fail to arrive or contact the guide within 30 minutes of the scheduled start time (No-Show), the guide is entitled to leave the meeting point; the service will be deemed fully rendered with a 100% fee applied.
9. Limitation of Liability — Guests are responsible for assessing their own physical condition and wearing appropriate footwear for urban walking paths. The guide shall not be held liable for personal injuries, accidents, or loss of personal property resulting from guest negligence.
10. Intellectual Property — All website content, tour descriptions, texts, and publications are protected under copyright law (Italian Law 633/1941). Unauthorized reproduction or commercial use is strictly prohibited.
11. Applicable Law, Jurisdiction & ODR — For online booking disputes, EU residents may access the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. These terms are governed by Italian law, and any disputes shall be submitted to the exclusive jurisdiction of the Court of Messina, Italy.
